Instagram Contest Terms and Conditions “A Stay on Ile de Ré”

 

Article 1 — Object

SAS HELOISE’S CHOICE (hereinafter the “Organizing Company” or “Heloise’s Choice”), a company with capital of €1,000, whose registered office is located at 17 rue Eugène Delacroix, 75116 Paris, France, registered with the Trade and Companies Registry under number 845-133-628-00014, represented herein by Ms. Olivia Le Calvez, in her capacity as General Manager, is organizing a contest* (hereinafter the “Contest”), jointly with Olivia Le Calvez, Hôtel de Toiras (hereinafter the “Partner”), from 10/07/2020 at 4:00 pm to 16/07/2020 at 11:59 pm on the Heloise’s Choice Instagram page (https: //www. instagram.com/heloise.choice/) and on the partner’s Instagram page (https://www.instagram.com/hotel_de_toiras/).

Article 2 — Participation

2.1 Access to the contest

This contest is open to any natural person of legal age, residing in France and throughout the world, (hereinafter the “Participant”), with the exception of members of staff of the structures organizing the Game, and any person who has participated directly or indirectly in its organization or its realization, as well as their spouse and family members: ascendants and descendants.

When designating the winner, the Organizing Company reserves the right to ask any Participant to justify these conditions. Any person who does not meet these conditions or who refuses to justify them shall be excluded from the Game and may not, in the event of a win, benefit from the prize. Similarly, any false declaration, indication of identity or address will result in the immediate elimination of the Participant.

Participation in the Game requires for any person to be in possession of an Instagram account beforehand.

Participation in the Game implies full acceptance of these rules.

 

2.2. Terms and conditions of participation

The Organizing Body will post a visual on its page on the theme “A Stay on Ile de Ré”.

The Participant shall:

– Subscribe to the account of the Organizing Body (https://www.instagram.com/heloise.choice/) and of the Partner (https://www.instagram.com/hotel_de_toiras/).

For this contest, 1 winner will be drawn randomly by the Organizing Body. Participation in the Game is done on the Instagram platform. As such, any registration by telephone, fax, postal mail, Twitter, Facebook or e-mail will not be taken into account. Participation in the Game implies full and complete acceptance of these rules, in all their provisions, the rules of ethics in force on the Internet, as well as the laws and regulations applicable to free games.

Any participation that is incomplete, inaccurate or does not comply with the above terms and conditions will not be considered and will therefore result in the participation being null and void.

 

Article 3 — Endowments

The allocation for the competition will be as follows:

– 2 nights with breakfasts for 2 in Port View Suite and 2 glasses of champagne valid from the date of issue of the gift voucher determined on July 17, 2020 until October 31, 2020. The gift voucher will be usable subject to availability.

The winner undertakes to accept the prize as offered, without the possibility of exchange for cash or other goods or services of any kind whatsoever. The Organizing Body reserves the right to replace the prize with another prize of equivalent value and characteristics, for any reason whatsoever, without its liability being incurred in this respect.

 

 

Article 4 — Designation of winners, allocation of prizes

4.1 Designation of winners

As soon as the Game closes, a winner will be drawn randomly. The winner drawn at random is the result of pure chance.

 

4.2 Allocation of prizes

The winner will be designated on 17 July 2020 at 6:00 pm and contacted within 7 days of the closing of the competition by private message by the Organizing Company or the Partner, in order to obtain his or her full contact details (surname, first name, address, telephone, e-mail, date of birth) which are essential for the award of the prize.

The prize will be sent within 10 days from the date of designation of the winner. The prize will not be sent by the Organizing Company, which declines all responsibility for its delivery.

If the winner does not show up within 3 days after the contact has been made, the latter will be considered as having renounced his prize and a new winner will be designated for the same prize.

The winner will have to comply with the rules. If it turns out that the winner does not meet the criteria of these rules, his prize will not be awarded.

The prize cannot give rise to any dispute or claim of any kind. The winner undertakes not to seek the responsibility of the Organizing Company in that the prize will not be awarded to him/her.

The lot will be accepted as advertised. No change of any kind whatsoever may be requested by the winner for any reason whatsoever. No consideration, compensation or financial equivalent of the prizes may then be requested, in whole or in part.

It is specified that the organizing company will not provide any service or guarantee, the prize consisting solely of the award of the prize provided for above.

 

 

Article 5 — Use of personal data

5.1 In the context of the Game, participants shall communicate to the Organizing Company, which shall be the sole recipient, personal data concerning them.

The contact details of the participants shall be used in accordance with the provisions of the French Data Protection Act of 6 January 1978 or any other law that may be substituted for it.

 

5.2 The winner expressly authorizes the Organizing Company to use his or her contact details (surname and first name) for advertising or public relations purposes, on any medium whatsoever, without restriction or reservation, and without this conferring on them any right to remuneration or any advantage whatsoever other than the award of their prize.

Article 6 — Limitation of liability

Participation in the Game implies unreserved acceptance of these rules in their entirety, the rules of ethics in force on the Internet, as well as the laws, regulations and other texts applicable in France.

Participation in the Game implies knowledge and acceptance of the characteristics and limitations of the Internet, particularly with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption and, more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the Internet network.

The Organizing Company shall not be liable in the event of malfunction of the “Internet” network or of the Instagram, Facebook and Twitter applications preventing access to the game or its proper operation. In particular, the Organizing Company shall not be held liable for any external malicious acts.

Although the Organizing Company shall do its utmost to offer users available and verified information and/or tools, it shall not, however, be held liable for any errors (in particular errors of posting on the Game sites, erroneous e-mails), lack of availability of information and/or the presence of viruses on the site.

 

It is the responsibility of each participant to take all appropriate measures to protect his or her own data and/or software stored on his or her computer and telephone equipment against any attack. The connection of any person to the site and participation in the game is done under his or her full responsibility.

Furthermore, the Organizing Company shall not be liable in the event of:

– Telephone connection problems,

– Hardware or software problems,

– Destruction of information provided by participants for a reason not attributable to the Organizing Company,

– Human or electrical error,

– Disturbances that could affect the smooth running of the game or malfunctions in the automated draw process.

In all cases, if the smooth administrative and/or technical running of the game is disrupted by a cause beyond the control of the Organizing Company, the latter reserves the right to interrupt the game. Any fraud or non-compliance with these rules may result in the exclusion of the game of its author, the Organizing Body reserves the right, where appropriate, to take legal action against it. Each photograph is published under the sole responsibility of the participant. The Organizing Company shall in no way be held liable in the event of a claim and/or action brought by any person on any grounds whatsoever in respect of the content or any rights whatsoever relating to the photographs published by the participants in the context of this game.

 

Article 7 — Interpretation of the Regulations

7.1 Access

The complete set of rules is available on the website of the Organizing Company at https://www.heloise-choice.fr/.

No oral requests concerning the Game will be answered. Any complaint must be addressed in writing to the Organizing Company at the above-mentioned address before 17/07/2020. After this deadline, no complaint shall be accepted.

 

7.2 Interpretation of the Regulations

Any question of application or interpretation of the rules, or any unforeseen question that may arise, shall be decided by the Organizing Company.

 

7.3 Amendments

The Organizing Company reserves the right to extend, shorten, modify or cancel the Game at any time, and in particular in the event of force majeure, without any compensation being claimed by the participants.

Any modification shall be the subject of an amendment filed on the Organizing Company’s website at https://www.heloise-choice.fr/

 

Article 8 — Applicable law and jurisdiction

These rules are subject to French law. Any dispute relating to the application or interpretation of these rules shall, in the absence of an amicable settlement between the Parties, fall within the jurisdiction of the Tribunal de Grande Instance de Paris.
